Abstract


The presence of a guardian (wali) in marriage holds a significant role in the Islamic legal system and within the social culture of many countries. The wali is considered a representative of the bride, responsible for ensuring that the marriage is conducted lawfully and in accordance with religious stipulations and requirements. In the context of Islamic law, the wali is someone who has the authority to officiate the marriage of a woman, aiming to protect her rights and ensure that the agreement in the marriage is carried out fairly. However, in practice, the existence of a wali often sparks debates, particularly regarding the role and rights of women in choosing their life partner. In this regard, differences in opinion among Islamic schools of thought, especially between the Hanafi and Shafii schools, provide distinct perspectives on the understanding and application of the walis role in marriage. These differences arise due to variations in the methods of interpreting religious texts and the social contexts in which the respective schools developed. For instance, the Hanafi school allows adult women to make independent decisions regarding marriage, reflecting the flexibility of Islamic law in accommodating diverse social conditions. Meanwhile, the Shafii school adheres to stricter traditions and principles of caution, aiming to protect women from potential exploitation or impulsive decisions.
